Terms of Service

These Terms of Service (the "Terms" or this "Agreement") are a binding agreement between you and BYTEWONDERS LLC, doing business as EasyTextNow® ("EasyTextNow", "we", "us"), 500 Westover Dr #30294, Sanford, NC 27330, USA. By using easytextnow.com or paying for the service you agree to these Terms and to our Privacy Policy and our Refund, Shipping, and Cancellation policies, which are incorporated into this Agreement. These Terms contain a binding arbitration provision and class-action waiver (Section 19) that affect your legal rights — please read it.

1. What the service is

EasyTextNow lets people on the outside exchange messages with an incarcerated person through the corrections email system, with an easy texting experience on your side. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the service for lawful, personal, non-commercial purposes while your account is in good standing. We are an independent service: we are not affiliated with, endorsed by, or acting on behalf of the Federal Bureau of Prisons, any correctional facility, or any corrections communications provider.

2. Eligibility, accounts & accurate information

You must be at least 18 years old and legally able to enter this Agreement. You agree to provide accurate, complete, and current contact and identification information (including your email, mobile number, and the inmate's register number) and to keep it updated. If information you provide is false, inaccurate, or incomplete, we may suspend or terminate service and refuse future use. You are responsible for everything that happens under your account and for keeping any credentials confidential; notify us immediately of any suspected unauthorized use.

3. Payments are a gift of service credit

Every payment you make is a gift of communication service to the incarcerated person you name. As the payer you control only the payment. Once applied, the credit and the account belong to the incarcerated person. How features are used — including photo prints, which are ordered by the incarcerated person from inside — is controlled by them, not by you. You are paying to enable their communication, similar to funding a commissary or phone account. Service credit has no cash value outside EasyTextNow and cannot be transferred except as we allow.

4. Plans & features

Features vary by plan. For example, AI assistant and web-search features are available only on qualifying plans. Boss includes one free photo order per billing cycle: any order, even one photo, consumes it; 1-15 photos and shipping are free, while 16-25 photos are free with $6.95 shipping. Later orders before the next cycle cost $0.40 per photo plus $6.95 shipping. The current plans, prices, and included features are shown on our pricing page and are displayed before you pay. We may add, modify, or retire features over time; if a change materially reduces what an active plan includes, we will provide notice and a fair remedy (such as a plan change or credit).

5. How messages flow (please read)

Message delivery is not symmetric, because of how corrections systems work:

  • To the inmate: our system relays your message within seconds; the corrections email system then applies its own processing, so delivery typically takes about 1 hour.
  • From the inmate: replies are released and processed by the corrections system on its own schedule and typically reach you in about 1 hour, sometimes longer.

Delivery ultimately depends on the facility and the corrections provider. We cannot guarantee delivery times, and messages may be delayed, monitored, or blocked by the facility.

6. Account setup; the account belongs to the inmate; multiple supporters

A new account does not work until the incarcerated person adds the assigned email address as a contact in their corrections computer system. Until they do, no messages flow, and emailing that address will not reach them. Getting that address to them through your normal channels is the fastest path. An incarcerated person may be supported by more than one payer: each payer's subscription and payments are independent, and we never disclose one payer's existence or information to another (see our Privacy Policy).

7. Acceptable use

You are responsible for the content you transmit. You may not use the service: for anything unlawful; to harass, threaten, defraud, or harm anyone; to send obscene, defamatory, or infringing material; to send spam or commercial/promotional messages; to circumvent facility rules; or to send content prohibited by the facility or our carriers. All communications must be personal and non-commercial. Inmate-to-inmate correspondence through the service is strictly prohibited; violations result in permanent account restriction and are reported to the staff of the facility where the violator is incarcerated, which may result in disciplinary action. The incarcerated person is responsible for knowing and following the rules of their facility, and violations of facility telecommunication rules may result in loss of the service. The service is not a replacement for a regular phone line and must not be relied on as your primary means of communication. We may suspend or terminate accounts that violate these Terms or facility/carrier rules.

8. Content monitoring & automated screening

We monitor the service for violations of this Agreement and for security. This includes automated screening of message content — including by artificial-intelligence systems — to detect spam, fraud, prohibited content, and unlawful activity. We may delay, block, quarantine, or remove communications that screening or review flags, and we may report suspected unlawful use (together with related account information) to correctional or law-enforcement authorities. Facilities and corrections providers also monitor everything on their side. Do not use the service for anything you would not want reviewed.

9. No emergency services (911)

The service does not provide access to 911, E911, or any emergency service. The phone numbers we assign cannot place or receive emergency calls, and messages are not monitored in real time for emergencies. Never rely on the service to request emergency help; use a regular phone line. We are not liable for any claim arising from the unavailability of emergency services through the service.

10. Billing & recurring-charge authorization

Prices are shown before you pay. By starting a subscription you authorize us (through Stripe) to charge your payment method on file automatically at the start of each renewal period, until you cancel. Each subscription charge is applied as service credit to the inmate's account, and the service renews by consuming that credit; one-time payments add credit that keeps the account active while funds remain. If credit runs out or a renewal charge fails, there is a short grace period with reminders before service pauses; while an account remains unpaid, the assigned phone number may be held for approximately 14 days before being released back to the carrier. Keep your payment method current and notify us of changes. Prices may change with notice, effective from the next renewal period. See our Refund and Cancellation policies.

11. Billing disputes & chargebacks

If you believe a charge is wrong, contact us at support@easytextnow.com within 30 days of the charge — most issues are resolved quickly. If you initiate a card dispute (chargeback) without contacting us first, we may suspend the associated service while the dispute is open, and we will respond to disputes with transaction evidence. Chargebacks found to be unwarranted may result in permanent loss of service and recovery of amounts owed.

12. Promotional & discount funds

Promotional credits, discounts, and referral bonuses are non-refundable, have no cash value, may not be transferred, and may only be used for their intended purpose.

13. SMS program terms (10DLC)

By providing your mobile number and opting in, you agree to receive account and delivery SMS from EasyTextNow at that number. Message frequency varies with your activity. Message and data rates may apply. Reply HELP for help or STOP to cancel. Carriers are not liable for delayed or undelivered messages.

14. Intellectual property

The service, site, software, content, logos, and trademarks (including EasyTextNow®) are the property of BYTEWONDERS LLC or its licensors. Except for the limited license in Section 1, no rights are granted. You may not copy, resell, sublicense, distribute, modify, decompile, disassemble, or reverse engineer any part of the service, remove proprietary notices, or use our trademarks without written permission. The phone numbers assigned to the service remain under our control and are not your property; numbers from canceled accounts may be reassigned. All rights not expressly granted are reserved.

15. Suspension & termination by us

We may suspend or terminate service, with or without notice, for violation of these Terms, unlawful or abusive use, violation of facility or carrier rules, non-payment, or where required for legal or security reasons. If we discontinue the service without cause, your only obligation is for charges through the date of disconnection, and unused credit will be handled under the Refund Policy.

16. Disclaimers of warranties

The service is provided "as is" and "as available", without warranties of any kind, express, implied, or statutory — including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that any message will be delivered by any particular time or at all. We do not control corrections systems and are not responsible for facility actions, lockdowns, transfers, policy changes, delays, monitoring, or blocking. No credit allowances are given for interruptions of service. Statements by us or our agents describing the service are informational and are not warranties.

17. Limitation of liability

To the maximum extent permitted by law: (a) we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, revenue, or profits; (b) we are not liable for failures caused by underlying carriers, service providers, vendors, corrections providers, facilities, equipment failure, or network outages; (c) we are not liable for third-party fees such as bank overdrafts or carrier charges; and (d) our total liability for any claim is limited to the amount you paid for the service in the 3 months before the claim arose. These limits apply to claims in contract, warranty, tort, product liability, or any other theory, whether or not we were advised of the possibility of damages, and include claims related to the unavailability of emergency services (Section 9). Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

18. Indemnification

You agree to defend, indemnify, and hold harmless BYTEWONDERS LLC and its officers, directors, employees, and agents from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the service, or content you (or the incarcerated person you support) transmit through the service.

19. Dispute resolution — binding arbitration & class-action waiver

Please read this section carefully — it affects your rights.

  • Informal resolution first: before filing any claim, you agree to send a written description of the dispute to support@easytextnow.com or to our mailing address below, and to give us 30 days to resolve it amicably.
  • Binding arbitration: any dispute arising out of or relating to the service or this Agreement (whether based in contract, tort, statute, fraud, or any other theory, and including disputes that arose before this Agreement) that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitrator may award the same relief a court could award to you individually.
  • Class-action waiver: disputes will be arbitrated only on an individual basis. Neither party may participate in a class action, class-wide arbitration, or representative proceeding.
  • Jury trial waiver: both parties waive the right to a trial by jury.
  • Small-claims carve-out: either party may instead bring an individual claim in small claims court where permitted.
  • Opt-out: you may opt out of this arbitration provision by mailing us written notice (name, contact info, and a statement that you opt out) within 30 days of first accepting these Terms.
  • If any part of this section is found unenforceable, the rest remains in effect; if the class-action waiver specifically is found unenforceable, then this arbitration section is void as to that dispute.

20. Governing law & venue

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Any claim not subject to arbitration will be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction.

21. General provisions

Entire agreement: these Terms and the policies incorporated into them are the entire agreement between you and us and supersede all prior statements, written or verbal. Severability: if any provision is held invalid, the remainder stays in effect. Survival: provisions that by their nature should survive (including Sections 14, and 16–20) survive termination. No third-party beneficiaries: this Agreement creates no rights for anyone who is not a party to it. No waiver: our failure to enforce a provision is not a waiver. Assignment: you may not assign this Agreement; we may assign it to a successor of the business. Notices: you agree that we may deliver notices about the service and changes to these Terms electronically (to the email or mobile number on file) or by posting on the site.

22. Changes to these Terms

We may update these Terms from time to time. The current version, with its effective date, is always posted on this page; changes become effective when posted, and material changes will be announced on the site or sent to the contact information on file. Your continued use of the service after a change takes effect constitutes acceptance. You are responsible for reviewing these Terms periodically.
