1. DESCRIPTION
These terms of service – hereafter known as the “agreement” or “terms” – constitute the entire agreement between you, EasyTextNow.com’s subscriber using our communication services, and us. This agreement is in regards to any and all services provided by EasyTextNow.com (also known as BYTEWONDERS LLC) through our website and/or speaking with a customer service representative. By making a payment you agree that you have read and accept the terms and conditions provided herein. You are responsible for regularly checking the company website for updates to these terms. EasyTextNow.com does not provide paper “statements” or “Terms and Conditions of Service”. Although our terms are almost always accessible on our website, we may send them to subscribers via email or postal mail. Also, we have the right to modify this agreement whenever we want; these changes will go into effect when they’re posted on our site. If you subscribe to any of our “Services”, including if modifications occur in the future, you agree that you’re bound by not only this Agreement but also any revisions that get posted later.
After the initial two days of set-up, all fees are non-negotiable. EasyTextNow cannot be held accountable for any funds not used within our services. When you make a payment, it is considered a gift to the inmate which can only be used for future transactions on this website; these funds have no cash value outside of EasyTextNow. By making a deposit, you agree that there will be no refunds under any circumstance unless notified by mistake within 48 hours of transaction completion.
2. OUR SERVICES
EasyTextNow.com hereby grants you an individual, nonexclusive, non-transferable, revocable license to access and use our services for non-commercial purposes only upon subscription of the Service. You agree not to sell, resell, duplicate, copy or distribute any portion of our service(s) for commercial exploitation nor make any claim suggesting otherwise. Any new features that we provide which can enhance the EasyTextNow.com service will be subject to these terms and conditions unless stated otherwise. We are not responsible for any communications, information, content, or materials that our subscribers submit to the service and they assume all responsibility and liability in this case. Furthermore, we have the right to restrict termination of any telephone numbers at our discretion. The subscriber is responsible for paying for all uses of this service in advance. The subscriber also agrees not to use the service unlawfully or abusively, or in any way that would damage the reputation, employees, facilities, third parties, or the public image of the service. It is the Subscriber’s responsibility to know and follow the rules set by the prison facility where he/she is incarcerated. The subscriber agrees to abide by any telecommunication rules associated with Federal, State, or Local prisons and understands that a violation of the rules may result in loss or suspension of this service. Under no circumstances is EasyTextNow.com to be held liable if an inmate’s location changes its telephone/messaging policy, resulting in any sort of EasyTextNow.com service(s) inconsistency or discontinuity. After the Subscriber account has been set up and created, a phone number will be given to the Subscriber. It should be noted that we at EasyTextNow.com do not have billing arrangements with any prison phone providers or inmate computer providers–hence our service also cannot accept collect calls either. By subscribing, you fully understand how to set up the EasyTextNow.com service(s), and it is your responsibility to take the next necessary steps. You also agree that EasyTextNow.com is not responsible for any third-party providers we may use in our company. If set up takes longer than anticipated, you are still required to pay for our services until said service(s) is cancelled by YOU, the customer/subscriber of ours here at EasyTextNow. The service term is the period of time for which EasyTextNow.com will bill you in advance (i.e., one month or one year). You chose your service term when you first signed up for our services, and it begins on either the subscription date—the date you first ordered our services, we gave you a phone number, or processed your payment (whichever event happened last)—or the later of those three events. Subscriber service will continue until canceled by Subscriber or EasyTextNow.com as provided for herein. Please note that the obligations of this agreement begin on your subscription date and are indefinite; however, Subscribers have the opportunity to cancel their services before the end of their current term. If they choose not to cancel, their service terms automatically renews for same duration unless stated otherwise . The renewal begins on the day after the last day of your service term. We will try to automatically bill your credit card. If payment fails then the account will be suspended and the phone number will be held for 14 days before being released to the carrier.
3. TERMS OF SERVICE
This agreement is a month-to-month contract. The monthly fee will be based on the plan Subscriber picked initially when setting up the account; even if calls/messages are not received, the monthly fee will still apply.
Subscriber can cancel at any time without penalty. However, please note that if you do choose to cancel service, your access to features and customer support will end immediately.
4. ACCEPTABLE USE
You will be held responsible for any transmissions you send through the EasyTextNow.com service(s). We have no control over the content of your transmission and cannot be held liable for such content. Additionally, you should not use our service(s) to create or distribute any images, sounds, messages or other materials which are obscene, harassing, racist maliciously fraudulent infringing or libelous; nor shall you use our services for ethical unethical immoral abusive activities toward a third party’s rights or anything illegal. In addition, you will follow all EasyTextNow.com rules, regulations, procedures and policies as well as any policies from the networks our service(s) is connected to. The subscriber agrees to follow all applicable laws including local ones, state ones, national ones, foreign ones and international laws and regulations. The subscriber is exclusively responsible for anything that happens under their account or password – this includes the content Subscriber transmits through the service(s). By subscribing to this service, you understand that all communications must be personal and for non-commercial purposes only. Sending spam or promotional messages is strictly prohibited and will result in your subscription being terminated. Our company strictly prohibits any and all inmate to inmate correspondence. If an inmate is found in violation of this rule, they will be subject to a permanent account restriction and ban from using our service. Furthermore, we report all violations of this rule to the staff at the facility where the offender is incarcerated which often results in disciplinary action being taken by prison officials.
5. ACCURACY AND SAFETY
By registering for the EasyTextNow.com service(s), you agree to provide us with accurate and complete contact and identification information. This will include a phone number or numbers, email address, etc. that you are responsible for maintaining the confidentiality of. If it is ever determined that provided information is false, inaccurate, incomplete, or not current, we reserve the right to suspend or terminate services and refuse all current or future use our services. EasyTextNow.com also has the right to immediately disconnect your service at any time without notice. You agree to enter registered private telephone numbers that you control or are under the common control of EasyTextNow.com respects your privacy and will take measures to protect it. If you suspect a security breach, such as loss or unauthorized disclosure or use of your account, notify us immediately.
If EasyTextNow.com believes the service has been used unlawfully, we will send the communication and other information (including Subscriber identity, contact info, and credit card details) to the appropriate authorities for further investigation. EasyTextNow.com should not be used to replace a Subscriber’s regular phone service, such as landline or mobile phone.
6. PAYMENT FOR SERVICES
EasyTextNow.com charges subscribers the rates that are in effect for their subscription plan, which can be found on our website (https://EasyTextNow.com/). These rates may occasionally be updated by EasyText Now and will become effective when they have been published to our site. Subscriber billing cycle starts on the day the first payment is made. Subscriber agrees that all payments will be made to EasyTextNow.com via valid credit or debit card, including MasterCard, VISA, American Express, Discover. If an ACH withdrawal from the Subscriber’s checking account is permitted by law and if accepted by EasyTextNow.comEasyTextNow.om has the right to change payment methods at any time without notice. The name and address of the Subscriber on the account must match the credit card account from which payment will be made. If Subscriber provides a valid credit card number, they authorize EasyTextNow.com to charge any amounts owed now or in the future to that credit card account and allows us to request immediate payment from their issuing bank. Every time Subscriber uses our service(s), they reaffirm that we are authorized to charge their chosen method of Payment. By subscribing to EasyTextNow.com, you agree to allow us to charge any online purchases made to the credit card account supplied at the time of subscription, or any alternate card on file. You also agree to pay all associated costs and expenses, including but not limited Attorney’s fees, should we need to take legal action in order collect payment under this Agreement. Lastly, please note that your first month of service is prepayment upon establishing your account with us. Fees, charges, and prices are all subject to change without notice and can be found on the EasyTextNow.com website. In addition, new products and/or services may be introduced at special introductory pricing. Lastly, if an account is behind or in default, EasyTextNow.com has the right to bill the subscriber more frequently.
7. CANCELLATIONS
By Subscriber.
If you try to canceling your service before the current term is up, you will be responsible for all charges incurred during said term, including any unbilled charges. Also, if there are services that come with a predetermined commitment and you cancel them before fulfilling said commitment, then you agree to pay EasyTextNow.com the corresponding recovery fees.
By EasyTextNow.com Without Reason.
If EasyTextNow.com discontinues service(s) without notice, the subscriber will only be responsible for past-due charges up to the date of disconnection, including a pro-rated final term charge and any associated fees.
By EasyTextNow.com With a Reason.
If EasyTextNow.com reserves the right to disconnect Subscriber service for any reason, it is then the Subscribers responsibility to pay all charges up until that point as well as any unbilled charges, and recovery costs. All unpaid balance at time of disconnection will need to be immediately paid in full. EasyTextNow.com will take appropriate measures to collect on disconnected accounts with outstanding payments and may report these unpaid late-charges to the credit bureaus.
8. BILLING
Subscribers of EasyTextNow.com must have a valid email address and an accepted payment method when subscribing to the service(s). If any changes happen to the payment method, including expiry, cancellation, or change of billing address, Subscribers must notify EasyTextNow.com immediately. Lastly, if for any reason whatsoever that we stop accepting your payments, know that it is within our rights as stated in this agreement. EasyTextNow.com will bill in advance all monthly or yearly charges, fees, taxes, and surcharges for each service to the Subscriber’s payment method. EasyTextNow.com collected full payment for the phone number and granted access to services on that date. From then on, we will automatically charge the credit card on file monthly or yearly-. Authorizes EasyTextNow: when subscribing to any of our services as a subscriber, you are authorizing us (EasyTextnow)to take/ deduct from your selected mode of Payment . EasyTextNow.com will have the authority to charge your payment method until 30 days after you terminate your subscription with us.
9. RECOVERY FEES
Any product or service you purchase from EasyTextNow.com that has a rebate or benefit connected to maintaining the subscription for a set amount of time–if you disconnect before the period is up, you agree to pay us the difference between what you paid and the regular advertised price at time of sign-up. This will be in addition to any other fees owed.
10. COLLECTION
By disconnecting the Subscriber service(s), EasyTextNow.com holdsSubscriber responsible for all charges under this agreement and any extraneous costs, including, but not limited to: collection agency fees and reasonable attorney’s fees that may arise.
11. BILLING DISPUTES
You have seven days to dispute any EasyTextNow.com charges on your bank or credit card statement after you receive the statement. If you do not contact us within that time frame, you waive your right to contest the charges. To dispute a charge, email us at [email protected]
12. NOTICES
Because it is hard for EasyTextNow.com to tell the difference between credit and debit cards, subscriber agrees to not have the right under Regulation “E” ELECTRONIC FUND TRANSFERS of the Federal Deposit Insurance Corporation laws and regulations, to receive 10 days advanced notice from EasyTextNow.com about how much will be debited from what the Subscriber uses as their payment method. Although EasyTextNow.com might provide billing messages every now and then,EasyTextNow.com does not promise to do so nor are they required too by law . Also, without needing to notifythe Subscriber first, EasyTextNow may change or stop said message at any given time .
13. CANCELLATION AND REFUNDS
Refunds are at the discretion of EasyTextNow.com and may be denied. Includes all setup fees, secondary line charges, service charges, and transfer charges.
There are times when an inmate cannot use our service. This can be because their access to the computer system has been restricted for reasons such as being offline or having an insufficient balance in their prison account. It could also be due to institutional lockdown, transfer, loss of privileges, or if they have been specifically banned from using our service by the institution.
We cannot give refunds if the prisoner is unable to use our service for any reason. By making our service available, we are upholding our end of the bargain.

14. TERMINATION OF SERVICE
Only the account holder can authorize cancellation of their account. Accounts must be canceled by using the customer dashboard subscription controls, or by contacting us at [email protected] If an appropriate form of termination is not used, Subscriber will remain responsible for all costs and fees associated with the account.
15. PROMOTIONAL AND DISCOUNT FUNDS
All promotional and discount codes are non-refundable and can only be used for their intended purpose. EasyTextNow occasionally offers discounts or promotions. Again, these are non-refundable and may not be transferred to other users.
16. DEFAULT/NEGATIVE BALANCE ON ACCOUNTS
If a subscriber of EasyTextNow.com has an overdue balance on a prepaid account for more than thirty days, we reserve the right to assume the account is in default, close the account, and begin collections proceedings. The subscriber agrees to be responsible for any associated EasyTextNow.com or third-party collection company fees, including attorney’s fees and costs. This account can only be reactivated once the negative balance is paid off and any other charges associated with reactivation or late payments are also cleared. If we terminate this agreement because of your default, we reserve the right to keep any prepaid fees or charges. We may require a reactivation fee to renew service(s) after termination or suspension. Any outstanding balance on the account will be charged to the credit card on file when the account is closed.
17. DISPUTE RESOLUTION AND BINDING ARBITRATION
Always be sure to read and understand every section of a document before agreeing to it. This particular section provides for disputes to be resolved through arbitration instead of going to court.
18. DISPUTE NOTIFICATION
The resolution of any complaints, issues, or claims relating to this Agreement will be handled through written notice between the parties. If an amicable solution cannot be reached within thirty days of receipt of said notice, then a mutually agreed upon third party will arbitrate the issue. By agreeing to arbitrate, both parties agree that this will be given the broadest meaning possible under law. This includes, but is not limited to disputes and claims arising out of or relating to any aspect of the relationship between Subscriber and EasyTextNow.com. These may include contract-based, tort-based, statute-based, fraud-based, misrepresentation- based or any other legal theory; disputes and claims that arose before this Agreement as well as thoseClaims that may arise after it has been terminated . Any dispute that is currently being litigated as an individual case, any class-action litigation in which the Subscriber is not a part of the certified class, and any claims concerning the limits of this arbitration provision. This agreement is between EasyTextNow.com and the Subscriber, which include any subsidiaries, affiliates, agents, employees of either party that are involved as well as anyone else who may be authorized or unauthorized users or beneficiaries of the service under this Agreement.
19. WAIVER OF JURY TRIAL
Both Subscriber and EasyTextNow.com agree not to have a trial by jury while under this Agreement.
20. MONITORING
We constantly monitor our service for any agreement violations, which encompasses using AI to read messages and detect illegal activity. If we think there has been a violation of this agreement or if it is necessary for security reasons, we will remove or block all communications. This measure is taken in order to protect EasyTextNow.com from any potential harm that could come from its affiliates, directors, officers, agents, and employees.
21. NO THIRD-PARTY BENEFICIARIES
If you are not privy to this agreement, you have no right to reimbursement, compensation, or legal action. Furthermore, this agreement does not establish any benefits for individuals outside of the contract.
22. ENTIRE AGREEMENT
This document, as well as any future changes to its terms found on our website, are the only agreements between you and EasyTextNow.com. This Agreement will be used to determine your use of our service, along with the members of your household and your guests or employees who may also use it. this agreement negates any/all prior statements concerning its purpose that have been made verbally or in writing.
23. CHANGES TO THIS AGREEMENT
The terms and conditions of this agreement may be updated from time to time. By subscribing our service, you agrees that any notices or information regarding EasyTextNow.com’s services can be delivered to you electronically. This would include changes in the agreements, new opportunities with text messaging services, etcetera. To be aware of any changes made to the terms, you as the Subscriber are responsible for frequently reviewing the company website. The date when changes are posted on the company website is when they become binding. When we post this agreement, it supersedes all electronic and written terms of service that have been previously agreed to–including but not limited to any other terms. If you keep using our service after we make changed, we will take that as your acceptance of said changes.
24. PRIVACY POLICY
At our company, we take data privacy seriously. We will never sell your information to anyone, for any reason. We may need to share your info with trusted third parties in some cases, such as when:
-A court orders us to do so
-We need to enforce our agreements or property rights
-We’re collecting payment for our products and services

25. LIMITATION ON WARRANTIES, REMEDIES AND LIABILITY.
Agreeing to our terms, you comprehend that our services are provided “as is,” unless specified below.
26. NO WARRANTIES ON SERVICE.
Our warranty does not include merchantability, fitness of the service or device for a particular purpose, title or non-infringement. In addition, we do not guarantee that the service or device will be perfect without any failures, delays, interruptions, errors,…etc. No EasyTextNow.com employee, officer, director, affiliate, agent or other service provider will be held liable for unauthorized access to our customers’ orour transmission facilities customer’s data files, programs, procedures, or information through accidental means, fraudulent devices, or any other method. This includes damage that happens as a result of EasyTextNow.com’s negligence as well as our service providers’ or vendors’. Please note that any statements or descriptions of our service or device by EasyTextNow.com or its agents are for information purposes only, and not given as a warranty of any kind.
27. DISCLAIMER OF WARRANTIES.
Please note that our service is provided “as-is” and we do not offer any warranties, whether express, implied, or statutory. In addition, we cannot guarantee the accuracy or quality of products or services promoted bythird parties on our site.
28. NO CREDIT ALLOWANCES FOR INTERRUPTION OF SERVICE.
If there are any interruptions in service on EasyTextNow.com, you will not be credited.
29. LIMITATION OF LIABILITY
We are not responsible for any delays in service, or poor quality, caused by, but not limited to:
– an underlying carrier, service provider, vendor, prison phone provider, or other third parties;
– equipment failure; or
– network outages.

30. DISCLAIMER OF LIABILITY FOR DAMAGES.
Our website, EasyTextNow.com, as well as any of our affiliates or agents will not be held legally responsible for any damages done to you – including but not limited to: personal injury, property damage, wrongful death, loss of data or revenue/profits – that may arise from the use or inability to use a device connected with our service, These limitations cover all emergency service personnel, including access to E911, basic 911, or emergency routing services. They also apply if you’re unable to obtain emergency help. These limitations extend to claims based in breach of contract, breach of warranty, product liability, tort law—and any other theories of liability. Please note that these limitations will effect you whether or not we were informed of any potential damage beforehand. Some states do not allow us to exclude or limit incidental and consequential damages, so the aforementioned limitation may not apply to you depending on your location.
31. LIMIT ON TOTAL LIABILITY
The service charges for the time period in question are the only easyTextNow.com liability under this agreement. We will not be covering third-party fees, including but not limited : banking fees, overdrafts, cellular phone bills, other wireline company’s surcharges (like a technician), or any other related monthly statement items.
32. INDEMNITY
By using our services, you agree to defend and protect us from any legal claims or damages sustained by you or a third party while using our services. This includes, but is not limited to indemnifying us for attorney fees should you break this agreement or communicate any harmful content through our service(s). If you cancel your subscription, we will not be held responsible for any deleted accounts, voice mails, communications, e-mails, data or information. Your number(s) may then become available to other subscribers.
33. PROPRIETARY RIGHTS
EasyTextNow.com agrees to keep all proprietary information, copyrights, trademarks, patents, and other intellectual property safe and sound. This includes but is not limited to the technology and telephone numbers utilized as part of our services. Under no circumstances may the subscriber or any third party access, copy, distribute, sell, disclose, lend, transfer convey modify decompile disassemble or reverse engineer the service(s). Additionally. The copyright notices and other proprietary legends must not be removed from the service(s), and no right to use any trademark is granted under this Agreement. The subscriber is not allowed to grant a sublicense, lease, or any other right concerning the service(s) to any third party. All rights that are not expressly granted under this Agreement will be retained by EasyTextNow.com.
34. COPYRIGHT & TRADEMARK
If you violate our website’s intellectual property laws by reproducing or attempting to reproduce copyrighted content, materials, services, logs, service marks or trademarks, you could face civil or criminal charges.
35. SURVIVAL
The terms in this Agreement that make sense to continue after it expires or terminates will survive.
36. LEGAL AGE
You agree that you are at least 18 years old and have read and fully understand the terms and conditions of this Agreement.
37. SEVERABILITY
Although any part of this agreement could be legally null and void, the other parts would still stand. This invalidity will not touch any other section of the agreement.
38. MULTIPLE SUBSCRIPTIONS AND ACCOUNT DUPLICATION
If you have more than 1 inmate, you need to pay separate subscriptions for each one. One subscription will only work for one inmate. Likewise, an inmate account can only be created once, if somebody else already registered the inmate with EasyTextNow, you cannot create a new subscription for the same inmate.
In some special cases we may override this rule on a case by case basis, as long as it doesn’t interfere with our FREE TRIAL MISUSE AND ABUSE POLICY.
39. SMS TERMS & CONDITIONS
Easy Text Now, also known as ‘BYTEWONDERS LLC’, offers Incoming and outgoing messages between inmates and their family and friends directly to their phone numbers as SMS. We currently have a 10DLC Campaign for Account Notification, Customer Care, Delivery Notification.
Opt-in: By providing your phone number, you agree to receive text messages from Easy Text Now. Message frequency varies depending on customers’ interactions and replies to messages. Message & data rates may apply. Reply STOP to opt out, reply HELP for help. Carriers are not liable for any delays or undelivered messages.
